Marriage
My husband and I have been married for 10 years and we have just discovered that the navy chaplain who conducted the ceremony wasn't licenced to perform marriages. Do we have to remarry?
No. The fact that you and your husband have lived for so long as a married couple indicates that you married in good faith. If you wish, you can apply to court to have your marriage declared valid.
Marriage

I left BC in 1988, and have been living in Taiwan for the greater part of 15 years. In 1995 I became engaged to a Taiwanese woman. I decided I didn't want to marry, but agreed to attend an "Engagement Banquet" so that she could save face. At the banquet there was no wedding license, no one to perform any ceremony, and we never registered a wedding afterwards. There were no vows, and no signatures. Two and a half years later, when I decided to end our stormy relationship, she informed me that we had been legally married! After consulting several lawyers, I discovered it was true. My fiance and I recently went to our priest to fill out some forms prior to getting married. Remarriage
I have been granted an order of divorce in B.C. on November 21, 2003. It will take effect on December 23, 2003, 31 days later. I am planning to go to Cairo in the beginning of 2004 to remarry. In Egypt, a woman, no matter what nationality she is, must be divorced for 3 months prior to obtaining a civil marriage. A lady friend of mine, an Indian citizen, got married to a Canadian Citizen. They had a child. Separation
My wife and I separated a couple of months ago, but we had sex last weekend. Are we still considered separated?
As long as you are living in separate homes, this will not affect your status as separated. If you live under the same roof, this may jeaopardize the legal requirement that you live "separate and apart" from one another.
My husband and I are separated but we still eat together and have sex every now and then. I wish to get a divorce on the ground of separation for a period of at least a year. Will this be a problem?
This might be a problem. The case law says that the test for separation is not only physical separation but the destruction of the matrimonial relationship. Even though you are living apart, the court may consider that you have nonetheless maintained your marriage.
I have been separated from my spouse for 2 years. I am thinking of purchasing a home and we have not legally separated. I do not wish to pay for a separation or divorce. Does "permanent separation" apply in BC like it does in some states? (by D of Nanaimo, BC)

Reconciliation
My husband and I separated thirteen months ago, but we reconciled and lived together for two months until we finally decided we couldn't make it work. Can we still get a divorce based on separation of not less than a year?
No, you can't, at least you can't right now. You'll have to wait until you have been separated for a full year since the last time you and your husband reconciled. Section 8(3)(b)(ii) of the Divorce Act says that you can reconcile and not interrupt the one year, but you can only reconcile for 90 days in that year.
We separated a couple of years ago and want to resume married life. Is there anything we have to do to get back together?
No, nothing at all. Since you didn't get a divorce, you're still married. Go ahead, move back in together!

Divorce
I have sued my husband for a divorce based on separation. In is counterclaim he has sued me for a divorce because I had an affair during our marriage. Will we have to deal with this in court?
In general, the court will not concern itself with what used to be called "marital offences," such as your adultery. Given the choice, and assuming that a year has passed, the court will likely prefer to grant the divorce based on separation rather than adultery. If this is the case, evidence concerning your adultery does not need to be head with respect to the application for a divorce order. It might arise in other contexts, however, so be prepared to deal with the issue.

My wife (Canadian) and I (German) got married in Ontario in 1985 and we lived in Vancouver for many years. In 2001, I took a job in Nigeria and the whole family moved to Lagos. Desk Order Divorces
My application for a desk order divorce was sent back to me by the court registry. What do I do now?
The court registry will "bounce" desk order applications for any number of reasons, from a timing error to a defect in how you've drafted the materials. When they bounce an application, they will usually attach a note to the front of the materials explaining their concern. Read the note, follow the instructions to fix the error and resubmit the documents; make sure you attach their note to the corrected materials! There will be no additional filing fee.
